1. Introduction

Welcome to getpestcontrol.services ("the Platform"), a pest control service booking platform operated by PestBooker LLC ("we," "us," or "our"), located at 8690 Aero Dr, Ste 115 #1076, San Diego, CA 92123.

By using this Platform to schedule pest control services, you ("you" or "the Customer") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. About the Platform

This Platform provides an online booking tool that allows homeowners to schedule pest control services with local pest control service providers ("Service Providers"). PestBooker LLC operates the technology platform but does not itself provide pest control services.

The actual pest control services are performed by independent, licensed Service Providers. When you complete a booking through this Platform, you are entering into a service agreement with the Service Provider, not with PestBooker LLC.

3. Booking Process

When using our Platform, you agree to:

• Provide accurate and complete information, including your name, phone number, email address, and service address
• Ensure you are authorized to schedule services at the address provided
• Provide valid payment information for the services you are scheduling
• Be at least 18 years of age

4. SMS Communications

By providing your phone number during the booking process, you expressly consent to receive SMS text messages from us, including:

• Booking Reminders: If you start but do not complete your booking, we may send up to three reminder messages to help you finish scheduling your service.
• Appointment Notifications: Confirmations, reminders, and updates about your scheduled pest control service.

Message frequency may vary. You may receive up to 5 messages per booking. Standard message and data rates may apply depending on your mobile carrier plan.

You may opt out of SMS messages at any time by replying STOP to any message you receive. Reply HELP for assistance. Opting out of SMS will not affect your ability to receive service from your pest control provider.

5. Payments

Payment for pest control services is collected through our Platform at the time of booking or as otherwise specified during the checkout process. By submitting payment, you authorize us to charge the payment method you provide.

All payments are processed securely through our PCI-compliant third-party payment processor. We do not store your full credit card information on our servers.

Refund and cancellation policies are determined by the individual Service Provider. Please contact the Service Provider directly regarding any refund or cancellation requests.

6. Service Provider Relationship

PestBooker LLC is a technology platform provider. We facilitate the connection between you and licensed pest control Service Providers but are not responsible for:

• The quality, safety, or outcome of pest control services performed
• The conduct, licensing, or insurance status of Service Providers
• Any property damage or personal injury arising from pest control services
• Service Provider pricing, guarantees, or warranties

Any disputes regarding the pest control services themselves should be directed to the Service Provider.

7. Limitation of Liability

To the maximum extent permitted by law, PestBooker LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any pest control services booked through it.

Our total liability for any claim arising from the use of this Platform shall not exceed the amount you paid through the Platform in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Platform's availability, reliability, or fitness for a particular purpose. We do not guarantee that the Platform will be error-free or uninterrupted.

9. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose
• Provide false or misleading information during the booking process
• Attempt to interfere with the proper functioning of the Platform
• Use automated tools to access or interact with the Platform without our permission

10. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to the practices described in our Privacy Policy.

11. Changes to These Terms

We may update these Terms of Service from time to time. Any changes will be posted on this page with an updated revision date. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated terms.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising from these terms shall be resolved in the courts located in San Diego County, California.
